Terms of Service

1. Acceptance of Terms

By accessing or using TravelyDeal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms constitute a legally binding agreement between you ("User") and André Luís dos Santos Carneiro Terra, trading as TravelyDeal, operating under Portuguese law. The Service is available at travelydeal.com.

2. Description of Service

TravelyDeal is a flight deal alert platform that:

• Monitors airfares across airlines and booking platforms
• Sends email notifications when prices drop to your target threshold
• Provides deal discovery for popular routes
• Offers affiliate links to partner booking platforms (via Travelpayouts)

TravelyDeal is an informational and alert service. We do not sell, issue, or manage airline tickets. All bookings are completed directly with airlines or third-party booking platforms. We are not responsible for the accuracy of prices shown by third parties at the time of booking.

3. User Accounts

3.1 Registration

You must be at least 16 years of age to create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at admin@travelydeal.com if you suspect unauthorised access.

3.3 One Account Per Person

Each individual may maintain only one account. Creating duplicate accounts to circumvent subscription limits is a breach of these Terms and may result in immediate termination of all associated accounts.

4. Subscriptions and Billing

4.1 Free Plan

TravelyDeal offers a free tier with limited features. No payment information is required for the free plan.

4.2 Paid Plans

Paid subscriptions unlock additional features (increased alert limits, priority notifications, etc.). Pricing details are available at travelydeal.com/#pricing.

4.3 Billing Cycle

Subscriptions are billed on a monthly or annual basis, as selected at checkout. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

4.4 Payment Processing

All payments are processed securely by Stripe, Inc., a PCI DSS Level 1 certified payment processor. By subscribing, you authorise Stripe to charge the payment method you provide on a recurring basis according to your chosen plan.

4.5 Price Changes

We may change subscription prices with at least 30 days' advance notice by email. Continued use after the effective date of a price change constitutes acceptance of the new price.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting admin@travelydeal.com. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent periods
• No partial refunds are issued for unused time within a billing period (except where required by the EU 14-day cooling-off right — see our Refund Policy)

6. Refunds and Cooling-Off Period

If you are a consumer resident in the EU/EEA, you have the right to withdraw from your subscription contract within 14 days of the date of initial purchase, without giving any reason. See our Refund Policy for full details of how to exercise this right.

7. Affiliate Links and Third-Party Services

TravelyDeal participates in the Travelpayouts affiliate programme. Some links in our deal alerts and on our platform are affiliate links — if you purchase a flight through these links, we may receive a commission at no additional cost to you.

We are not responsible for the content, accuracy, availability, or security of third-party booking platforms. Prices displayed are fetched from partner APIs and may change. Always verify the final price before completing a booking.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Scrape, crawl, or systematically download data from the Service
• Attempt to gain unauthorised access to any part of the Service or its servers
• Interfere with or disrupt the Service or servers connected to it
• Use automated tools to create multiple accounts or abuse the free tier
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or sublicence access to the Service without prior written consent

9. Intellectual Property

All content on TravelyDeal — including text, graphics, logos, icons, and software — is the property of André Luís dos Santos Carneiro Terra or its content suppliers and is protected by Portuguese and EU intellectual property law. You may not reproduce, distribute, or create derivative works without prior written permission.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, TravelyDeal shall not be liable for:

• Missed flight deals or price changes occurring between alert dispatch and booking
• Direct or indirect losses arising from third-party booking platforms
• Technical failures outside our reasonable control
• Any indirect, incidental, or consequential damages

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under Portuguese/EU law.

11. Service Availability

We aim to maintain high availability but cannot guarantee uninterrupted access. We may suspend the Service temporarily for maintenance, upgrades, or emergencies, with as much notice as reasonably practicable.

12. Termination

We reserve the right to suspend or terminate your account without notice if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. Sections 9, 10, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with Portuguese law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, without prejudice to your rights as a consumer under EU consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the changes, you must cancel your subscription before they take effect.
